Towards a new regime for crypto-assets in France

The PACTE draft Bill (Action Plan for Business Growth and Transformation) was adopted at its final reading in the French National Assembly on 11 April 2019. Once enacted, the law will establish a framework for fundraising via the issuance of virtual tokens (Initial Coin Offering - ICO) and digital assets services providers (DASP). Japan and France sign Cooperation Frameworks regarding Innovation

Japan’s Financial Services Agency (FSA) has signed two cooperation frameworks, respectively with the Autorité des Marchés Financiers (AMF) and the Autorité de Contrôle Prudentiel et de Résolution (ACPR) of France to promote innovation in their respective markets. This will lead to increased exchanges regarding innovative trends, regulatory issues and any other relevant information pertaining to innovation in the financial sector. These cooperation frameworks also include referral mechanisms for financial innovators which will therefore facilitate their entry into French or Japanese markets.

The AMF publishes an analysis on the trends of Initial Coin Offerings (ICOs)

On the occasion of the 2018 Annual Conference and following the launch of the UNICORN (1) programme one year earlier which accompanies fundraising initiatives based on cryptocurrencies, the AMF publishes a study on ICOs both in France and globally. This study is based on two main parts: the analysis of French projects based on lessons learned from meetings organized in the framework of this programme and the results of a questionnaire as well as the analysis of the global market.

The Autorité des marchés financiers and the Mauritius Financial Services Commission signed a Fintech cooperation agreement

With a view to promoting innovation in financial services on both markets, Robert Ophèle, Chairman of the Autorité des marchés financiers (AMF), and Harvesh Seegolam, Chief Executive of the Mauritius Financial Services Commission (FSC), signed an agreement on the support of innovative financial operators and on the dialogue between the two authorities. The AMF and FSC also wish to improve their mutual understanding of their respective regulations.

The AMF publishes the summary of responses to the public consultation on initial coin offerings (ICO)

Among the 82 responses made to the Autorité des marchés financiers’ consultation, a large majority of respondents expressed support for setting up an appropriate legal framework for this new type of fundraising. The AMF Board has decided to continue work on definition of a specific legal framework for ICOs.

Canadian securities regulators sign agreement with the French Autorité des marchés financiers

The securities regulatory authorities in Alberta, British Columbia, Manitoba, New Brunswick, Nova Scotia, Ontario, Québec and Saskatchewan (participating jurisdictions) today announced a co-operation agreement with the French Autorité des marchés financiers (French AMF, based in Paris, France). This agreement will allow the participating jurisdictions and the French AMF to refer novel businesses seeking to enter the others’ markets.

The AMF and ACPR launch the FinTech Forum

The FinTech Forum is a new body for consultation and dialogue with the FinTech industry. The forum, whose goal is to gain a clearer picture of the regulatory and supervisory challenges linked to financial innovation, met for the first time today.
