New recommendation by the ARPP to increase regulation of advertising for financial and investment products

The provisions for the recommendation will go into effect no later than 23 April 2014.

The European Commission puts forward a proposed regulation on key information documents concerning RIPs

Registration of financial intermediaries

The Decrees of 26 January and 1st March 2012 on registration of financial intermediaries and financial investment advisers were issued in application of Articles L. 546-1 to L. 546-4 of the Monetary and Financial Code, created by Article 36 of the Law on banking and financial regulation of 22 October 2010. The first decree defines the role of the Organisme pour le Registre des Intermédiaires en Assurance (ORIAS), the second draws the consequences of the obligation to register FIAs in the single register mentioned in Article L. 546-1 of the Monetary and Financial Code.

The European Commission (EC) has set up a task force on PRIPs (Packaged Retail Investment Products) that draws involves the three European regulatory committees (the CESR, the CEBS and the CEIOPS). The aim is to develop a horizontal approach on pre-contract information and marketing rules governing financial products available to the general public, irrespective of the legal wrapper through which such products are sold.
