The Enforcement Committee of the Autorité des Marchés Financiers fines Morgan Stanley & Co International Plc for manipulating the price of sovereign bonds and a sovereign bond futures contract

In its decision of 4 December 2019, the Enforcement Committee imposed a fine of €20 million on Morgan Stanley & Co International plc for manipulating the price of 14 French government bonds (OAT) and 8 Belgian bonds (OLO) on 16 June 2015, and also manipulating the price of an OAT futures contract.

In its decision of 19 November 2019, the Enforcement Committee imposed fines of €300,000 each on Novaxia Investissement and Joachim Azan, its chief executive officer at the time of the facts, and a warning against Mr. Azan. It also fined Novaxia Développement, Novaxia Gestion and Novaxia €50,000, €10,000 and €20,000 respectively for obstructing the conduct of the inspection.

The Enforcement Committee of the Autorité des Marchés Financiers fines a financial investment advisor for breaching its professional obligations

In its decision of 28 October 2019, the Enforcement Committee handed down a fine of €25,000 to Financière Henry IV Société Nouvelle, a financial investment advisor, for failing to carry out the necessary checks prior to the marketing of a Luxembourg alternative investment fund (AIF) that was not authorised in France. It also issued a warning to its CEO, Tony Csordas, and fined him €75,000.

The AMF Enforcement Committee fines a biotechnology company and its chairman for breaching the obligation to disclose inside information as soon as possible

In its decision of 1 October 2019, the Enforcement Committee imposed on Biophytis and its chairman, Stanislas Veillet, penalties amounting to, respectively, €100,000 and €20,000 for breaching their obligation to disclose inside information to the market as soon as possible. This information concerned a significant delay in the launch of phase 2 clinical trials of two flagship drug candidates.

The Enforcement Committee of the Autorité des Marchés Financiers fines Natixis Investment Managers International and Natixis Asset Management Finance for breaching their professional obligations

In its decision of 25 September 2019, the Committee fined the asset management company Natixis Investment Managers International €2,000,000 for breaches relating to the information provided to investors as well as to its management of conflicts of interest. The Committee also fined Natixis Asset Management Finance €1,000,000 for failing to comply with the obligation to act honestly, loyally and professionally in the interest of its investors.

In its decision of 25 July 2019, the Enforcement Committee imposed a fine of €200,000 on Forest Invest and issued a warning to the company and its senior manager for breaches of their obligations relating to the management of forestry groups.

The Enforcement Committee of the Autorité des Marchés Financiers fines an investment services provider and three financial investment advisors for breaching their professional obligations

In its decision of 2 July 2019, the Committee issued a reprimand to Invest Securities, an investment services provider (ISP), and fined it €90,000 for failing to carry out the necessary checks prior to the marketing of a British alternative investment fund (AIF) that was not authorised in France. The Committee also fined Mr Carlotta and the companies Portal Conseil and Exec Finance, €20,000, €50,000 and €60,000 respectively for having recommended this product to some of their clients, in their capacity as financial investment advisors.

In its decision of 1 July 2019, the Committee fined Prado Paradis Patrimoine €50,000 for breaches of several of its professional obligations. It also imposed a fine of €100,000 on its CEO, Solange Dahan, and issued a reprimand to her.

In its decision of 13 June 2019, the Committee fined Infinitis €20,000 for breaching its professional obligations within the framework of its order reception and transmission activity. However, the Committee found that objections pertaining to the provision of a non-guaranteed investment service and to the absence of a procedure for selecting the products and suppliers referenced on the company’s platform were not characterised.
