Ban on the advertising of Forex products, binary options and some CFDs: AMF launches consultation on changes to its General Regulation

The “Sapin II” bill on transparency, the fight against corruption and the modernisation of the economy will impose a ban on the advertising of certain highly speculative and risky financial contracts to private individuals by electronic means. In order to finalise the regulatory framework, the Autorité des Marchés Financiers (AMF) is launching a consultation, until 30 September 2016, on the introduction into its General Regulation of the categories of contracts targeted by the ban.

The AMF and ACPR launch the FinTech Forum

The FinTech Forum is a new body for consultation and dialogue with the FinTech industry. The forum, whose goal is to gain a clearer picture of the regulatory and supervisory challenges linked to financial innovation, met for the first time today. The Autorité des Marchés Financiers (AMF) and Autorité de Contrôle Prudentiel et de Résolution (ACPR) will coordinate its work.

The Autorité des Marchés Financiers introduces the concept of ‘premarketing’ of funds in France

As part of ongoing FROG work to improve the distribution of French investment funds abroad, the Autorité des Marchés Financiers (AMF) is adjusting its policy to make it easier to launch new funds in France. The ‘premarketing’ concept is being introduced, and the AMF is adapting its definition of the act of marketing units or shares in undertakings for collective investment in transferable securities (UCITS) or alternative investment Funds (AIF) in France.

The Cypress Securities and Exchange Commission (CySEC) has announced that Pegase Capital Ltd, a company under CySEC supervision that provides investment services through the websites www.interactiveoption.com, www.interactive-option.com, www.hellobrokers.com, www.mtxplus.com and www.pegasecapital.com has decided to renounce its authorisation.

AMF public consultation on the abolition of its classification of collective investment undertakings

Complementing its participation in the FROG working group, which aims to enhance the positioning of French asset management internationally and to give the industry the best available distribution tools, the Autorité des Marchés Financiers (AMF) is questioning the need to retain its classification guidance of collective investment undertakings. This classification exists only for French funds and the AMF is launching a public consultation on the issue. The deadline for responses is 29 July 2016.

The AMF announces the creation of a FinTech, Innovation and Competitiveness division headed by Franck Guiader

The AMF is creating a separate division, operational as of 1 June, to respond to changes in consumption patterns which have been amplified by technological innovation and the globalisation of financial services.
