A major investor protection milestone: the AMF sets specifics for its ban on the advertising of the riskiest products

For several years, the AMF has focused its attention on exposing the danger posed to retail investors by highly speculative products such as forex and binary options trading. In addition to calls for public awareness campaigns, the regulator introduced and now commends the measure included in the “Sapin II” law (1) to ban electronic advertising for certain products. The details of this provision, which represents a considerable step forward for consumer protection, have now been specified.

Changes to the intermediation in miscellaneous property system: the AMF Lauches a consultation on modifications to its general regulation

Law no. 2016-1691 of 9 December 2016 on transparency, the fight against corruption, and the modernisation of economic life (the “Sapin II” Law) introduces a change in the system of intermediation in miscellaneous property, as set out in Article 79. Consequently, the Autorité des Marches Financiers (AMF) is launching a public consultation, running until 31 January 2011, on the modifications to some of the provisions in its General Regulation.

The Autorité des Marchés Financiers (AMF) is reviewing the opportunity of intervening in the regulation of entities that advise businesses on company mergers and transfers, external growth transactions and the opening up of capital. This "corporate finance advisory” is currently not regulated as such. The AMF is thus launching a consultation on this topic that will run until 28 February 2017.
